Therefore, a challenge to agency action by means of judicial review is more likely to prevail on issues of legal procedure than on the substantive merits of the agency’s decision. By reviewing the decisions and regulations of the agency, the court will provide a safeguard against arbitrary action. Under the doctrine of separation of powers, each branch of government provides checks and balances against the other branches and contributes to the ongoing development and refinement of the law. Separation of powers can be seen among the three branches of state government, as well as among the three branches of the federal government.
Thus, federal courts may only exercise jurisdiction in particular types of cases. To understand the decision of a federal court, the first step is to determine why the federal court had jurisdiction of that particular case. For example, federal courts have jurisdiction over cases arising under federal statutes.
